Terms of Service

These Terms of Service govern your access to and use of Daily Email Marketing Solution ("DEMS"). By registering or using the service, you agree to these terms.

Accounts

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. We may suspend accounts that violate these terms or pose security or abuse risk.

Subscriptions & billing

Paid plans are Starter ($29/month or $290/year), Growth ($59/month or $590/year), and Pro ($99/month or $990/year). Yearly billing is ten months of the monthly rate (two months free). Features, limits, and renewals are described at purchase and may be updated with notice. Fees are generally non-refundable except as stated in our Refund Policy.

Acceptable use

You may not use DEMS to send unlawful, deceptive, or unsolicited bulk email in violation of applicable laws (including CAN-SPAM, CASL, and GDPR where applicable), to harvest emails without authorization, to attack systems, or to interfere with other customers. You must honor unsubscribe and suppression requirements for campaigns you send.

Your content & credentials

You retain ownership of content and lists you upload. You grant us a limited license to host and process that content solely to operate the service. You are responsible for SMTP, IMAP, and other credentials you store and for compliance with third-party provider terms.

Service availability

We strive for reliable uptime but do not guarantee uninterrupted service. Features may change as we improve the product. We are not liable for deliverability outcomes that depend on your lists, content, reputation, or third-party ISPs.

Limitation of liability

To the maximum extent permitted by law, DEMS and its operators are not liable for indirect, incidental, special, or consequential damages, or lost profits, arising from use of the service. Our aggregate liability for claims relating to the service is limited to the fees you paid us in the three months preceding the claim.

Changes

We may update these terms by posting a revised version. Continued use after the effective date constitutes acceptance of the updated terms.
